1. About this Agreement
This Agreement is between you ("you", "the buyer") and Bicycle Arbitrage ("we", "us"). By clicking "I Agree" and completing payment for the Bicycle Arbitrage course (the "Product"), you accept these Terms and Conditions in full.
2. What you are buying
The Product is a private digital course consisting of (a) a written textbook delivered as a PDF, (b) supporting bonus video content, and (c) access to a private Discord community. The Product is delivered electronically via email and via a private download link. Access is granted to you personally and may be revoked for breach of this Agreement.
3. No refunds (digital product)
Because the Product is a digital good delivered immediately upon successful payment, all sales are FINAL and NON-REFUNDABLE. You acknowledge that you forfeit any statutory right of withdrawal where permitted by law by clicking "I Agree" and proceeding to checkout. You agree that you will not initiate a chargeback or payment dispute on the basis of dissatisfaction with the contents of the Product after you have received the download link or accessed the community.
4. Australian Consumer Law
Nothing in this Agreement excludes any non-excludable guarantees implied by the Australian Consumer Law (ACL). Where the Product is found to be defective, our liability is limited (at our option) to re-supplying the Product or refunding the price paid. This clause does not give you any right to a refund for change of mind, lack of effort, or failure to apply the material.
5. Licence — personal use only
We grant you a non-exclusive, non-transferable, revocable, personal licence to access and use the Product for your own private learning. You MUST NOT: (a) share, resell, redistribute, publicly post, or upload the textbook, videos, or any part of the Product; (b) use the Product to train any AI/ML model; (c) remove or alter any copyright or attribution notices; (d) circumvent any access controls, including the download token system or the Discord invite gate.
6. Intellectual property
All intellectual property in the Product — including the textbook, videos, scripts, branding, copy, layout, and all original content — remains the sole property of Bicycle Arbitrage. Purchase of the Product does not transfer ownership.
7. No professional advice
The Product is general educational material and is not financial, legal, tax, mechanical, or business advice. You bear full responsibility for your own buying, repair, safety, and selling decisions. You must comply with all local laws, road rules, marketplace rules, consumer-protection rules, and tax obligations that apply to you.
8. Safety disclaimer
Bicycle repair, modification, and resale can result in injury, death, or property damage if performed incorrectly. You agree that you will work within your skill level, use appropriate safety equipment, and have safety-critical components (brakes, steerers, forks, frames) inspected by a qualified mechanic where appropriate. We accept no liability for any injury, loss, or damage arising from your application of the Product.
9. Limitation of liability
To the maximum extent permitted by law, our total aggregate liability to you for any claim arising out of or in connection with the Product is limited to the amount you actually paid for the Product. We are not liable for any indirect, incidental, consequential, special, or punitive damages, including lost profits, lost income, or lost opportunity.
10. Community conduct
Access to the Discord community is conditional on respectful conduct. We may suspend or revoke your access for harassment, spam, advertising, doxxing, sharing of paid course material, or any other conduct we reasonably consider damaging to the community. Revocation for breach is not a ground for refund.
11. Updates to the Product
We may update, add to, or modify the Product at any time. You are entitled to the current version of the Product at time of purchase. Future major editions may be offered to existing buyers at our sole discretion and may carry an upgrade fee.
12. Governing law
This Agreement is governed by the laws of New South Wales, Australia. You agree to submit to the exclusive jurisdiction of the courts of New South Wales for any dispute arising under or in connection with this Agreement.
13. Acceptance
By ticking the acceptance box and proceeding to Stripe Checkout, you confirm: (a) you are at least 18 years old; (b) you have read these Terms in full; (c) you accept them as a binding contract; (d) you understand that the Product is non-refundable; (e) you will not redistribute the Product.
